Working time in 2014
In 2014, the working time will be 250 days, i.e. 2,000 hours. The amendment to the working time regulations will enable the employer to plan schedules more flexibly and adjust them to the actual needs of the company.
Calculation of the working time
The employer sets a schedule (working time schedule) for at least one month and communicates it to employees at least one week before it becomes effective. The method of determining the working time for an employee is governed by Art. 130 of the Labor Code. and applies to all working time systems, excluding continuous work.
The working time in the adopted settlement period is calculated as:
- by multiplying 40 hours by the number of full weeks in the billing period,
- adding to the obtained number of hours the product of 8 hours and the number of days remaining until the end of the billing period, falling from Monday to Friday,
- reducing the working time by 8 hours for each holiday occurring in the settlement period and falling on a day other than Sunday,
- reducing by the number of hours of justified absence from work per hours to be worked during this absence, in accordance with the adopted working time schedule.

Possibility to extend the billing period up to 12 months
In accordance with the new regulations of the Labor Code in force since 23 August 2013, the settlement period may be extended to a maximum of 12 months, if it is justified by objective, technical or work organization reasons, in accordance with the general principles of protecting the safety and health of employees (Article 129 § 2 kp). Accordingly, the extension of the working time settlement period may be applied in any working time system.
The extension of the working time settlement period to 12 months is agreed in writing and communicated to the employees:
- in a collective labor agreement or in agreement with company trade unions,
- in the absence of a trade union organization in an agreement concluded with employees' representatives, selected in the manner adopted by a given employer (Article 150 § 3 of the Code of Civil Procedure).

On days when the holiday falls on a non-working day (resulting from an average five-day working week), the employer is obliged to indicate another day off in a given settlement period. In 2014, there will be two days for which an additional day off should be designated: May 3 and November 1.
Exception - working hours in continuous operation
Continuous work is a specific schedule of working time, which provides for a short settlement period not exceeding four weeks. It makes it possible to extend work per week to an average of 43 hours and one day in one week, in two or three weeks of the settlement period, up to 12 hours. When calculating the working time in the discussed system, the number of changes planned by the employer in a given settlement period in the amount of 12 hours is taken into account. The working time is therefore calculated by multiplying 8 hours by the number of calendar days in the settlement period, excluding Sundays, public holidays and non-working days resulting from the working time schedule in an average five-day working week. Then, the number of hours corresponding to the extended weekly working time with a given employer is added to the sum obtained.
